IRS CANNOT DO ANYTHING WITHOUT a Federal Court order!
Notice: I am not giving anyone advice and not intentionally causing civil disobedience or unrest. I am simply relaying items I have come to know under my 1st Amendment rights to freedom of speech. I do not want the Patriot Act to take me away without any reason for an indefinite period of time.
THEY CANNOT DO ANYTHING WITHOUT a Federal Court order!
I didn’t hear about (after diatribe number 6,324, you’ll see at the end) this in the mainstream media. People still get letters saying the IRS will seize your assets unless you do or pay ‘X’ BUT THEY CAN’T ENFORCE!
I haven’t heard that it went to any higher court either. It seems only proper they have to sue and then get a judgment like everyone else.
Also, the Supreme Court as ruled 3 times that the 16th Amendment does not grant the Federal Government ANY new powers of taxation. Since the income tax law is based on powers given by the 16th Amendment, any unapportioned tax (like the income tax) is unconstitutional.
This does not mean that people who know this have not been convicted in much lower courts such as a recent Judge was quoted as saying “I will not have the Supreme Court in my court” and would not let the jury here the defendants’ constitutional arguments. They were found guilty, of course, a few months ago. Butt they are appealing up the ladder.
But more and more people are ignoring citizen’s income taxes and winning in court.
Oh! But you might say “now my taxes are going up because someone yahoo is not paying their fair share to keep the Government operating” but did you know that the income tax is to finance the Feral Reserve System. Yes, our tax dollars are mainly to pay the PRIVITE Corporation, The Federal Reserve System, the interest to borrow our OWN MONEY that our Treasury Department prints. This does not include the digital money “printed” at their corporation (most of the US wealth) we pay interest on.
Also, corporations still have to pay income tax.
The national debt went from 1 trillion when Bush II started to now over 8 trillion. No wonder the Fed can afford such a low Prime Rate! Bankruptcy law as been changed to protect banks who give credit cards to anyone at usury rates.
Both of these acts passed on Christmas Eve when most of the 2 Houses where at home in 1913! If we stop the Federal Reserve System, no income taxes are needed. The States do need some money BUT base their income on the Federal system.
Illinois and I believe all States use the standard “If you owe Federal Income Tax” so they will need funding another of MANY constitutional ways.

U.S. Court of Appeals Rules IRS
Cannot Apply Force Against A Tax Payer
Without A Court Order
Tax Payers Free To Ignore An IRS Summons
Queensbury, NY – On January 25, 2005, the U.S. Court of Appeals for the Second Circuit held that taxpayers cannot be compelled by the IRS to turn over personal and private property to the IRS, absent a federal court order.
Quoting from the decision (Schulz v. IRS, Case No. 04-0196-cv),
“…absent an effort to seek enforcement through a federal court, IRS summonses apply no force to taxpayers, and no consequence whatever can befall a taxpayer who refuses, ignores, or otherwise does not comply with an IRS summons until that summons is backed by a federal court order…[a taxpayer] cannot be held in contempt, arrested, detained, or otherwise punished for refusing to comply with the original IRS summons, no matter the taxpayer’s reasons, or lack of reasons for so refusing.”
Without declaring those provisions of the Code unconstitutional on their face, the court, in effect, nullified key enforcement provisions of the Internal Revenue Code, stripping the IRS of much of its power to compel compliance with its administrative demands for personal and private property. The court characterized IRS summonses issued under Section 7602 as mere “requests.”
The court went on to say that the federal courts are there to protect taxpayers from an “overreaching” IRS, and that the IRS must go through the federal courts before force can be applied on anyone by the IRS to turn over personal and private property to the IRS.
